SENIOR DEMOCRACY ADVISOR
To carry out all necessary considerations and hearings, precedent to the Council’s final adoption of Long Term Plans (LTP) and Annual Plans (AP) which give effect to the strategic direction and outcomes set by the Policy, Finance and Strategy Committee through setting levels of service, funding priorities, the performance framework and budgets.
§ Development of a framework and timetable for the LTP and AP processes.
§ The nature and scope of engagement and public consultation required.
§ Statements to the media.
§ Such other matters as the Subcommittee considers appropriate and which fall within its Terms of Reference.
§ Informal engagement with the community, and the hearing of any formal public submissions.
§ Consideration of submissions on Hutt City Council’s Assessment of Water and Sanitary Services.
Consider and make recommendations to Council:
§ Levels of service, funding priorities, performance framework, budgets, rating levels and policies required as part of the LTP or AP, excluding any policies recommended to Council by the Policy, Finance and Strategy Committee.
§ Consultation Documents.
§ Council’s proposed and final LTP.
§ Council’s proposed and final AP.
§ Final content and wording, and adoption of the final Hutt City Council Assessment of Water and Sanitary Services.

Appointment as the local authority’s representative on another organisation
5.47 You may have been appointed as the authority’s representative on the governing body of a council-controlled organisation or another body (for example, a community-based trust).
5.48 That role will not usually prevent you from participating in authority matters concerning the other organisation – especially if the role gives you specialised knowledge that it would be valuable to contribute.
5.49 However, you could create legal risks to the decision if your participation in that decision raises a conflict between your duty as a member of the local authority and any duty to act in the interests of the other organisation. These situations are not clear cut and will often require careful consideration and specific legal advice.
5.50 Similarly, if your involvement with the other organisation raises a risk of predetermination, the legal risks to the decision of the authority as a result of your participation may be higher, for example, if the other organisation has made a formal submission to the authority as part of a public submissions process.

Purpose of Report
1. The purpose of this report is to provide updated Appendices 1 and 2 information to reflect changes and corrections to content from the audit process and from internal review processes.
That the Subcommittee recommends that Council receives the information.

Appendix 1 – Consultation Document
2. The Consultation Document (CD) on the draft Long Term Plan 2021-2031 is attached as Appendix 1 to the agenda distributed on 24 March 2021. This report includes an updated version of Appendix 1 following further review and feedback received.
3. The following changes have been made to the CD:
- On page 3 in the Contents page, ‘Connecting communities’ has been replaced with ‘Connected communities’.
- On page 43 in the section ‘The impacts of climate change on our city’, there has been a correction to the dollar impact. The corrected version is as follows: ‘In addition to this work, research by LGNZ in 2018/19 quantified the (then) current quantity and value of infrastructure exposed to sea level rise at four increments: 0.5, 1.0, 1.5 and 3.0 metres and then quantifies replacement value (hutt.city/LGNZ-sealevelreport). The scope of this research project primarily included roads, three waters infrastructure and buildings. Data was also collected on other types of infrastructure, including greenspace, jetties and airports. While the report did not provide council by council analysis: the replacement cost in the Wellington region was assessed at around $3 billion.’
- Other minor editorial changes include:
o A few corrections to grammar and improvements to sentence construction to clarify meaning,
o Change URL for District Plan to a shorter version,
o Correct sentences in the RiverLink section and re- arrange text in the section to improve clarity of meaning,
o Silverstream Landfill content - clarify and expand on the description of proposed investment in asbestos capacity and safety of the transfer station,
o Re-arrange some headings and sub-headings in the document,
o Replace the photograph in the housing supply section,
o Add a new footnote to the Development Contribution Policy table on catchment charges and move an existing footnote from elsewhere in the policy to the table
o Some re-wording in the feedback form and the tidying up of some tick boxes in the form.
Appendix 2 – Draft Long Term Plan 2021-2031
4. The detailed draft Long Term Plan 2021-2031 content was distributed as a supplementary agenda on Friday 31 March 2021, as Appendix 2. This report includes an updated version of Appendix 2 following further review and feedback received. 5. The following changes have been made to the DLTP:
- Section 3 - Removal of the ‘source’ column for key performance indicators. This is internal reference information that is not required to be published.
- Section 3 - Corrections to capital project names in Transport.
- Section 3 - Insertion of Prospective Statement of Comprehensive Revenue and Expense for Open Spaces, Parks and Reserves Activity.
- Section 3 - Correction of Corporate Services capital projects table which is currently labelled City Governance.
- Section 3 – Adding additional financial variance commentary which had been omitted in error.
- Section 4 - Correction to significant forecasting assumption on the level of uncertainty for capital programme achievability assumption to be ‘moderate.’
- Section 5 – remove references to proposal for UPL to align with consultation document language.
- Other minor editorial changes and design tidy up.
Climate Change Impact and Considerations
6. The matters addressed in this report have been considered in accordance with the process set out in Council’s Climate Change Considerations Guide. Climate impact statements need to be compiled for decisions/projects that affect greenhouse gas emissions (in relation to both Council’s own emissions and city-wide emissions) and/or are affected by a changing climate (e.g. sea level rise, etc.).
7. The draft LTP directly responds to the need to achieve emission reductions, by embedding emission reductions in a range of initiatives. For example, Council’s proposed investment in Naenae Pool includes that the new building would not use natural gas for heating and instead utilise alternative low-carbon energy sources. The proposed LTP also includes a number of projects to reduce emissions, including the decarbonisation of Council facilities (including pools and the Dowse) and by investing in public charging stations in order to help accelerate the uptake of electric vehicles in the community.
8. Other critical work to improve the city’s resilience is underway and is driving investment in three waters infrastructure, RiverLink, Eastern Bays Shared Path, and Te Ara Tupua. The rollout of the new rubbish and recycling service will contribute to less waste entering our environment.
9. Council has recently established a lead group on climate change made up of community and business representatives and Mana Whenua. The lead group will work with our community as we jointly develop a road map for the city of how to move to zero emissions by 2050, and how we can collectively respond to the likely climate change impacts. The road map will provide a coordinated view of the different community actions being undertaken to address climate change. Planned community engagement in the coming months will assist in helping our city’s transition to a zero-carbon emissions economy by 2050.
10. Where applicable, climate impact statements are, or should be, in place for each of the key initiatives or investments that have been included in the DLTP.
11. The most relevant legislation includes the Local Government Act 2002, Local Government (Rating) Act 2002 and the Rating Valuations Act 1998. The documents referenced in this report have been prepared to meet the legislative requirements.
12. As part of the process of preparing the DLTP for consultation, there has been specialist external legal advice provided across key aspects such as the Development Contributions Policy and Rating Policy.
13. Financial considerations associated with the CD and DLTP have been addressed in previous reports to the Subcommittee and Council.
