That the Committee recommends that Hutt City and Upper Hutt City Councils agree to the development of the proposed Health and Hygiene Bylaw 2018 and in so doing approves the proposed timeframe outlined below for its development: (i) Sign off timeframe: (a) 2 March 2018 Hutt Valley Services Committee (b) 13 March 2018 Hutt City Council ordinary meeting (c) 11 April 2018 Upper Hutt City Council ordinary meeting (ii) Staff prepare proposed bylaw by late April 2018. (iii) Approve proposed bylaw for special consultative procedure and recommend establishing a joint hearings subcommittee and membership of that subcommittee: (a) 4 May 2018 Hutt Valley Services Committee (b) 22 May 2018 Hutt City Council ordinary meeting (c) 23 May 2018 Upper Hutt City Council ordinary meeting (iv) Public notice given in Hutt News and Leader papers after 23 May 2018. Purpose of Memorandum
1. This memorandum sets out a proposed timeframe for the development of a joint Health and Hygiene Bylaw for both Hutt City and Upper Hutt City Councils. Prior to proceeding as set out in the timetable, the approval of each Council would be required.
Background
2. At the last meeting of the Hutt Valley Services Committee it was requested that the proposed Health and Hygiene Bylaw be added to the agenda for its February meeting with a report detailing a timeline for its progress.
3. Below is a proposed timeline for the development of the proposed bylaw:
2 March 2018 Hutt Valley Services Committee – sign off timeframe.
13 March 2018 Hutt City Council ordinary meeting.
11 April 2018 Upper Hutt City Council ordinary meeting.
Staff training and development of proposed bylaw completed by late April 2018.
4 May 2018 Hutt Valley Services Committee – sign off proposed bylaw recommending establishing a joint hearings subcommittee and membership of that subcommittee.
22 May 2018 Hutt City Council ordinary meeting.
23 May 2018 Upper Hutt City Council ordinary meeting.
After 23 May 2018 – Public notice given in Hutt News and Leader papers. Special consultative procedure starts after Friday 8 June 2018 and finishes after Monday 9 July 2018.
If submissions are received the joint hearings subcommittee to then agree time, date and location of hearing.
Any other action required from the joint hearings subcommittee to be determined after submission period has closed.

PROJECT PENCARROW PROGRESS REPORT 26 OCTOBER 2017 - 24 JANUARY 2018
Purpose of Report
1. The purpose of this report is to update the Committee on the progress of Project Pencarrow.
That the Committee notes the progress on Project Pencarrow as outlined in the report. |
Background
2. The report is similar in format to the series of reports, which have updated the Committee on the progress of the project.
Discussion
DBO Contract Progress
3. The Seaview Treatment Plant and other contract works continue to operate under the DBO contract.
Trade Waste Management
4. No significant adverse trade waste events have occurred since the last report.
Resource Management Processes
5. There have been no operational non-compliances with respect to the Trunk Wastewater resource consents recorded in this reporting period.
6. Wellington Water has submitted the application to Greater Wellington Regional Council (GWRC) in regards to the discharge of fully treated effluent to the Waiwhetu stream during heavy rain events and when the main outfall pipeline is offline for maintenance.
7. A dry weather discharge occurred from the Regent Street pump station on 16 February 2018. The discharge did not cause an environmental impact as it was contained within the Petone stormwater system which was sucked out. The neighbour’s backyard was affected and a full cleanup and disinfection was undertaken.
Network Development
8. Hutt Valley Wastewater Services (HVWS) are upgrading the Esplanade Central pump station, work to commence in February 2018. This includes replacing the stairs for health and safety reasons.
Network Maintenance
9. HVWS have engaged Intergroup to undertake the CCTV work on the trunk main from Upper Hutt to the Seaview Wastewater Treatment Plant (WWTP).
Consultation
10. Liaison has been maintained between officers of the two Councils and Wellington Water.
11. Liaison with officers from GWRC has been maintained.
12. After an article appeared in the Eastbourne Herald regarding odour, HVWS and Wellington Water visited the complainant. The meeting was very productive with the gentleman stating that the article was out of proportion. HVWS to continue dialogue with all wastewater treatment plant neighbours including the Kokiri Marae.

SILVERSTREAM LANDFILL UPDATE
Purpose of Report
1. The purpose of the report is to update the Committee on progress at the Silverstream Landfill.
It is recommended that the Committee notes the progress on Silverstream Landfill. |
Background
2. This is the latest in a series of ongoing reports to update the Committee on activities at the Silverstream Landfill. Stage 2 of the landfill has now been operating for eight years and the development of additional air space is an ongoing requirement.
Discussion
General Operations
3. The landfill continues to be operated at a high standard by Waste Management Limited. An extension to the operations contract is currently being renegotiated with Waste Management Limited.
Waste Volumes
4. Monthly waste volumes and the six month rolling average remain steady at just over 10,000 tonnes a month (see graph 2 attached as Appendix 2).
Landfill Waste Levy/Pricing
5. The collection of the landfill levy by Council has been and is ongoing and compliant with Ministry for the Environment (MfE) requirements.
RMA Consents
6. The landfill is being operated in accordance with resource consents.
Monitoring
7. The ongoing monitoring of surface water quality, macro invertebrates and groundwater shows no adverse effects resulting from the operation of the landfill.
Development
8. A detailed landfill sequencing strategy has been developed for the next five years of capital development. This plan integrates capital and operational development of the landfill.
9. Graph 1 (attached as Appendix 1) shows the creation of air space against the incoming waste stream. The graph shows the capital development work keeping ahead of waste against a number of different waste volume scenarios.
Landfill Gas Partner
10. Pioneer Energy Limited continue to run the landfill gas collection system and power plant.
11. There is ongoing commitment from Pioneer to improve gas work collection efficiencies.
Emissions Trading Scheme (ETS)
12. Improvements are being made to the monitoring of landfill gas generation and destruction at the landfill. This will assist in making the annual reporting easier.
13. The annual reporting required by ETS has been completed. The report submitted to the Environmental Protection Agency confirms that over 90%, (the maximum per cent allowed to be claimed under the scheme), of all gases emitted from the landfill are being captured and destroyed in the production of electricity from the site.
14. This result:
(a) means that Hutt City Council’s financial liability under the ETS is negligible; and
(b) confirms the high level of environmental performance of Silverstream Landfill.
Timetable
15. Indicative timings for the landfill capital development programme are as follows:
- January 2018 Slope 6 and 7 East construction commences
- June 2018 Slope 6 and 7 East to be completed
Consultation
16. A Residents Committee meeting will be held in February.

Financial Considerations
18. There are no financial considerations at this time.
Other Considerations
19. Health and Safety is a matter of importance at the landfill. There is ongoing work involving Council and its Contractors and Consultants to improve the awareness of Health and Safety issues and remove potential risk. As part of the contract renegotiation note above, Waste Management have committed to a full-time Health and Safety resource on site.

Recent Activities
Operation
Operationally the cemetery continues to be presented to a high standard and there have been no incidents of note to report. As at December 2017 a total of 38 additional first interments have been accommodated from Hutt City over the past six months. This number of additional burial is in line with the estimate prepared last year for budgeting purposes and represents 46% of total burials for that period. The work load created by the additional burials have been covered by the use of contractors to carry out the back filling operation using machinery.
General
The expenditure to 31 December 2017 indicates that the total operating expenditure is currently sitting at $190,202 which is $23,076 above the year to date operational budget. The total operating revenue received for the same period, is $202,926 which is $7,630 above year to date budget.

Hutt Valley Trunk Wastewater Services Financial Statements for the Period Ended 31 December 2017
Purpose of Report
1. To provide the Hutt Valley Trunk Wastewater Services Financial Statements for the six month period ended 31 December 2017.
It is recommended that the Committee: (i) notes the financial statements for the Hutt Valley Trunk Wastewater Services for the period ended 31 December 2017; (ii) notes a net deficit of $5.8 million which is $0.4 million unfavorable to budget; (iii) notes that the current share of operational funding from Upper Hutt City Council of 36% and Hutt City Council of 64%; and (iv) notes that the current share of capital funding from Upper Hutt City Council of 30% and Hutt City Council of 70%. |
Discussion
2. This report sets out the Hutt Valley Trunk Wastewater Services financial statements for the six month period ended 31 December 2017, attached as Appendix 1 to the report. Overall actual results reflect a $0.4 unfavourable result.
The Financial Statements include the following:
a) Statement of Operating Income and Expenditure
b) Statement of Capital Expenditure
c) Fixed Asset Register Summary
These financial statements relate to the provision of Hutt Valley Trunk Wastewater Services only.
There are two matters to draw your attention in this report:
a) The funding share for operational activities shows 64% HCC vs. 36% UHCC. This is due to trade waste rebates of $428k under revenue being split 85% HCC and 15% UHCC rather than a 69%/31% share of other revenue and expense items.
b) As of 1 July 2017, the funding model for services provided by Wellington Water Limited changed. From this date, Councils in the Wellington Region bulk fund Wellington Water their Council’s ‘three water’ operational and capital expenditure requirements based on approved budgets contained in their Long Term and Annual Plans. After each quarter end, actual expenditure incurred by Wellington Water on behalf of each Council is compared to budget and differences are settled by way of a wash-up. The wash-up will occur October, January and April with full actuals recorded at each financial year end.
Financial Considerations
3. There are no other financial considerations. There are no issues of a financial nature to bring to members’ attention.
Consultation
4. A copy of the Financial Statements for the six month period ended 31 December 2017 has been forwarded to officers of the Upper Hutt City Council.
Other Considerations
5. In making this recommendation, officers have given careful consideration to the purpose of local government in section 10 of the Local Government Act 2002. Officers believe that this recommendation falls within the purpose of the local government in that it provides information to Council with Trunk Wastewater Services that are shared with Upper Hutt City Council.

During November/December a free microchipping service was offered to dog owners in Lower Hutt.
Hutt City Council (HCC) has a contract with Upper Hutt City Council to hold dogs, including in situations where infringements or court action is being processed. HCC also microchip dogs for Upper Hutt City Council. HCC also offer limited boarding services to dogs in the Hutt Valley.
As the contractor providing the service we interact with K9, the contractor for Upper Hutt City Council, with regard to animal shelter issues, microchipping and euthanasia. Over the last four month period all interaction and services have been of a good nature and professional.

Administration – Training and Points of Interest
Food work:
Officers from Hutt City Council and Upper Hutt City Council worked together to compile an up-to-date spreadsheet of all Upper Hutt food premises. This included those premises already registered under the Food Act 2014 and those yet to transition.
Our spreadsheet shows premises yet to be registered under the new Food Act, identifying the risk based measure they fit under and their transition year. It also identifies the appropriate fees to be charged, based on the risk based measure, so that invoices can be issued.
Hutt City Council officers supplied an example of an explanatory covering letter to be sent out to Upper Hutt premises with the invoices. Our spreadsheet can also be used to project anticipated income from the new fee structure and schedule premises for transitioning and verifications.
Noise:
A HCC Environmental Health Officer monitored noise levels emanating from a gymnasium in the CBD (aerobics class) and found the activity to be compliant.
There have been ongoing noise complaints about truck movements at the Linked Earthworks site, Jupiter Grove. Meetings have been held with the business owner and there has been ongoing communication with the complainants. A noise test has been undertaken, the findings of which revealed unreasonable noise levels arising from the vehicle reversing alarms. This is being followed up with the operator to request changes to the reversing alarms to reduce the noise.
Amusement devices
Two amusement device permits were issued in this reporting period.
Bylaws
Two bylaw complaints were received and investigated in this reporting period.
Camping grounds
The two camping grounds in Upper Hutt were inspected in June 2017 for the 2017/2018 financial period.
Controlled purchase operations (CPO)/After Hours Compliance Visits
After hours compliance checks carried out in Upper Hutt did not raise any concerns.
No controlled purchase operations have been carried out.
Food complaints

Hazardous substances
There are no hazardous substance issues to report.
Mobile travelling shops (non-food)
Seven licences were approved in August 2017. No inspections have been carried out for this reporting period, but are scheduled to be completed by June 2018.
Mortuary
The sole mortuary in Upper Hutt was inspected in June 2017 for the 2017/2018 financial period.
Sale and Supply of Alcohol Act
There were 18 queries in total for this reporting period.
Toxic algae
Risk status over November and December 2017 was considered to be high. Signs were erected advising the public against swimming in the Hutt River, given the increased danger to public health.
Due to the heavy rainfall in December 2017, Greater Wellington assumed that much of the algae would be flushed out of the river. The Hutt City Council is awaiting formal notification from Greater Wellington Council to remove the signage and to confirm the Hutt River is safe for the public to access.
