Report no: HCC2017/3/79

Granting of Easements over Local Purpose Reserve (Road), Wise Street, Wainuiomata

Introduction

1.    This brief report will ensure that formal legal access over Council owned land is registered on new titles to be issued for the development of properties at the end of Wise Street in Wainuiomata.

Recommendation

That Council grant easements for rights of way, rights to drain water and sewage, and rights to convey water, gas, electricity and telecommunications over the Hutt City Council owned Local Purpose Reserve (Road), being Lot 10, DP 336174, situated at the end of Wise Street, Wainuiomata, in favour of Lots 1 and 6 DP 302320.

Background

2.    It has recently come to light that two properties at the end of Wise Street, being Lots 1 and 6 on DP 302320, which are being subdivided for residential development, do not have registered rights of way and other easements over part of the land on which access to the properties is provided. This land is a Hutt City Council owned local purpose reserve for roading purposes, which will in time be vested as legal road. A plan showing the two properties (green) and the local purpose reserve (pink) is attached as Appendix 1.

3.    The rights of way and other easements are required to be granted for the two properties to enable the subdivision to be legally effected. Hutt City Council as the owner of the land has the delegated authority under the Reserves Act 1977 to grant the rights of way by way of resolution.

4.    Easements for rights of way, right to drain water, right to drain sewage, and rights to convey water, gas, electricity and telecommunications were included in easements noted on Survey Plan DP336174 when the area was further subdivided in 2004, but were never registered on the two affected titles.

5.    Other adjacent property owners to the local purpose reserve already have these legal rights over the reserve, so this resolution will ensure all property owners have the same legal rights.
